These Terms of Use (“Terms”) govern your access to and use of the Helical Edge archery ballistics application (the “App”), associated website (the “Website”), and any related services (collectively, the “Services”) provided by Helical Edge (“we,” “us,” or “our”). By accessing or using the Services, creating an account, downloading the App, or otherwise interacting with us, you agree to be bound by these Terms and our Privacy Policy (incorporated herein by reference). If you do not agree to these Terms, do not access or use the Services.
We may update these Terms from time to time. We will notify you of material changes by posting the revised Terms on our Website and updating the effective date. Your continued use of the Services after such changes constitutes your acceptance of the new Terms. You are responsible for periodically reviewing these Terms.
1. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services. By using the Services, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms. If you are using the Services on behalf of an entity, you represent that you are authorized to bind that entity to these Terms.
2. Account Registration and Security
To access certain features, you must create an account by providing an email address and password. You agree to provide accurate, current, and complete information during registration and to update it as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized access or security breach.
We reserve the right to suspend or terminate your account at any time for any reason, including violations of these Terms.
3. Subscription and Payments
The Services include free features and premium features available via subscription. Subscriptions are managed and processed through WP Engine, our third-party platform, using Stripe for payment processing.
- Subscription Details: Annual subscription at $34.99 (subject to change). Subscriptions auto-renew unless canceled. No refunds for partial periods.
- Payment Processing: All payments are handled by WP Engine and Stripe. We do not collect or store your payment information. You authorize WP Engine/Stripe to charge your provided payment method for the subscription fee, plus applicable taxes.
- Cancellation: You may cancel anytime through your WP Engine account dashboard. Cancellation takes effect at the end of the current billing cycle.
- Taxes and Fees: You are responsible for all taxes, duties, and fees associated with your subscription.
- Free Trials (If Offered): Any free trial periods are subject to these Terms. We may require payment information upfront and charge at trial end unless canceled.
Failure to pay may result in suspension or termination of premium access.
4. Use of the Services
License Grant: Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use. This includes entering and storing archery-related data (e.g., sight marks, peep height, arrow mass, draw length, arrow speed, nock height, stabilizer notes, sight brand/model) in the App, which syncs to Google Firebase for access across your logged-in devices.
Features:
- Real-time ballistics calculations in the App.
- Pin sight alignment using your device’s camera (real-time only; no recording or storage).
- Cloud syncing of data to Firebase.
- Printable PDF sight tapes and marks via web browser (formatted for 8.5 x 11 paper).
- Note: Real-time calculations and camera features are App-only; printables are web-only.
Restrictions: You may not:
- Use the Services for any illegal, unauthorized, or harmful purpose.
- Modify, reverse-engineer, decompile, or create derivative works from the Services.
- Interfere with the Services’ operation, security, or other users.
- Use automated tools (e.g., bots, scrapers) to access or extract data.
- Share, sell, rent, or sublicense the Services.
- Upload viruses, malware, or harmful code.
- Impersonate others or provide false information.
- Engage in harassment, spam, or unsolicited communications.
- Use the Services in a way that could endanger yourself or others (e.g., relying solely on calculations for safety-critical archery decisions).
User Content: Any data you input (e.g., bow setups, notes) is your “User Content.” You retain ownership but grant us a worldwide, royalty-free, perpetual license to host, store, use, reproduce, modify, and distribute your User Content as necessary to provide the Services (e.g., syncing to Firebase). You represent that your User Content does not infringe third-party rights and complies with these Terms.
We are not responsible for backing up your User Content. You should maintain your own backups.
5. Intellectual Property
All content, software, designs, trademarks, logos, and other materials in the Services (excluding User Content) are owned by us or our licensors and protected by copyright, trademark, patent, and other intellectual property laws. You may not copy, distribute, or use them except as expressly permitted.
“Helical Edge” and related marks are our trademarks. Unauthorized use is prohibited.
6. Disclaimers
The Services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
We do not warrant that:
- The Services will be uninterrupted, error-free, or secure.
- Ballistics calculations or sight marks will be 100% accurate (factors like environmental conditions, equipment variations, or user input errors may affect results).
- The Services are suitable for professional, competitive, or high-stakes use.
Archery involves inherent risks, including injury or property damage. You assume all risks associated with using the Services for archery activities. Always verify calculations independently, use proper safety equipment, and consult professionals. We are not liable for any harm arising from reliance on the Services.
7. Limitation of Liability
To the fullest extent permitted by law, we, our affiliates, officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising from or related to your use of the Services, even if advised of the possibility of such damages.
Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim (or $100 if no payments were made).
Some jurisdictions do not allow certain limitations, so these may not apply to you.
8. Indemnification
You agree to indemnify, defend, and hold harmless us, our affiliates, officers, directors, employees, agents, and licensors from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising from: (a) your use of the Services; (b) your violation of these Terms; (c) your User Content; or (d) your infringement of third-party rights.
9. Termination
We may terminate or suspend your access to the Services at any time, without notice or liability, for any reason, including violations of these Terms. Upon termination, your license ends, and you must cease using the Services. Provisions that by nature should survive (e.g., disclaimers, limitations of liability, indemnification) will remain in effect.
You may terminate by deleting your account and uninstalling the App.
10. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Washington, USA, without regard to conflict of laws principles. Any disputes arising from these Terms or the Services shall be resolved exclusively in the state or federal courts located in King County, Washington. You consent to personal jurisdiction and venue therein.
We encourage informal resolution first—contact us before pursuing formal action.
11. Third-Party Services
The Services integrate with third parties like Google Firebase (for data storage and auth), WP Engine (for subscriptions), and Stripe (for payments). Their terms apply to your use of those components. We are not responsible for third-party services, including downtime, data loss, or privacy practices.
12. Force Majeure
We are not liable for delays or failures due to events beyond our control, including acts of God, war, terrorism, pandemics, strikes, or natural disasters.
13. Severability and Waiver
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect. Our failure to enforce any right does not waive it.
14. Entire Agreement
These Terms, along with our Privacy Policy, constitute the entire agreement between you and us, superseding any prior agreements.
